Any establishment / contractor undertaking a building and construction work employing 10 or more building / construction worker, with a total cost of construction amounting to more than rupees ten lakhs, is required to take registration under theBuilding and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 [in short referred to as BOCW Act] and comply with the provision of this act along with the Building and Other Construction Workers Welfare Cess Act, 1996 [in short the BOCW Cess Act] which bestows upon the employer / contractor, the responsibility of payment of labour cess at the rate of at least one per cent. of the cost of construction.
